PROCEDURE OF ESTABLISHING THE PLACE FOR CUSTOMS PROCESS AT INLAND CLEARANCE DEPOT (ICD)
I. Conditions of establishing the place for customs process at ICD ((ICD – Inland Container Depot or Inland Clearance Depot) based on point I.2 section 4 part B Circular 112/2005/TT-BTC dated 15/12/2005 stipulated by Ministry of Finance.
1. Enterprise who registers business of forwarding, carrying export and import goods; trading warehouse.
2. Area for establishing ICD must be met the following conditions:
a. Being established when there is a deadlock of export and import goods at the international seaport and being projected in the ICD system announced by Ministry of Communications and Transport;
b. Having an area of 10ha and over;
c. Conditions must ensure the working conditions for Customs agencies such as working place, checking place, area for goods, area for containers, warehouse for violating exhibits.
d. warehouse, areas must be fenced to separate with the surrounding area, being equipped a system of cameras, scanners, electric scales, multifunctional cranes, forklifts and other equipments to release the goods quickly. Goods in and out the warehouse must be managed by a system of computer. These systems and equipments are connected with a supervising system of Customs agency.
3. Location for establishing the ICD (based on the instruction of Ministry of Communications and Transport in the official correspondence no. 2548/BGTVT-KHĐT dated 21/4/2008)
a. Located near main transport barriers to seaport and near the source of import and export goods (industrial parks, export processing zone, etc), goods in big containers with stable growth and two-way exploiting abilities, both export and import.
b. Connected properly with international traffic system, used reasonably all means of transportation to increase the effect of expense, time and safety during the transport process.
c. ensuring to have enough land to meet the demand for long-term development.
d. Ensuring other involved elements such as: traffic safety, environment protection criteria during the process of building and exploiting.
II. Establishing documents: (point I.3 section 4 part B Circular 112/2005/TT-BTC dated 15/12/2005 of the Ministry of Finance)
a. Document of suggesting the establishment: 01 original.
b. Document of approving of People’s Committee of province, city where the ICD is established.
c. Business Registration Certificate: 01 copy
d. Facts of economy, construction technique: 01 copy
đ. Operation system: 01 original
Documents of establishing ICD are sent to the General Department of Customs.
The General Department of Customs investigates the following contents:
- Checking the project of domestic port;
- Checking documents;
- Surveying the actual conditions of warehouse;
- evaluating the ability of meeting the requirements stipulated at item 2, clause 4, Decree 154/2005/NĐ-CP dated 15/12/2005 of the Government, and point I.1, I.2 above.
Deciding authority
Within 30 days since the date of receiving all legal documents of the enterprise, the General department of Customs completes the investigation, reports the result and submits the decision of ICD establishment to The Minister of Finance.
